This Privacy Policy describes how Alerzo Limited (“Alerzo”, “we”, “us”, “our”, or “the Company”) collects, records, holds, stores, uses, discloses, transfers and processes your personal data when you visit our website-www.shop.alerzo.com or mobile applications owned and operated by us( together, the "Site" ).We shall collect and process personal data in accordance with applicable laws and regulations.

We are committed to conducting our business in accordance with applicable data protection laws and principles in order to ensure that the confidentiality of personal information provided to us is protected and maintained.

Under the provisions of the Nigeria Data Protection Act 2023 (DPA), Alerzo is the data controller regarding your Personal Data, which is collected for the purposes of managing your business relationship with Alerzo.

2. COLLECTION, USE AND DISCLOSURE OF YOUR PERSONAL DATA
2.1.
Where you use our services, we shall be required to collect certain Personal Data in line with this Privacy Policy as required by applicable legislation. If you do not agree to the collection or use of your personal data, you may withdraw your consent at any time but please note that we may not be able to provide you with our services.
2.2.
We reserve the right to amend this Privacy Policy at any time, and the date of last update will be reflected at the bottom of this Privacy Policy. We shall post a notification of any material changes to the Privacy Policy on the website.
2.3.
You are deemed to have accepted the changes to our Privacy Policy where you continue to access and use the service on the Site.

Where you provide personal information belonging to a third party to us, we assume that the required consent of the relevant third party has been obtained by you.

4. Lawful Basis
4.1.
The Nigerian Data Protection Act 2023 provides that we need to have a lawful basis for processing your personal information. At least one of the following must apply: contractual or legal duty, legitimate interest, public interest, vital individual interest or consent.

The Lawful basis we rely on for processing your personal information include:

Your Consent: We require your consent to market and communicate our products and services. However, you can always unsubscribe from receiving our marketing content. Please note that, if you withdraw your consent in relation to Personal Data that is significant to the Services, Alerzo may suspend its provision of products and/or services to you.

Contractual Obligation: We collect certain information from you to fulfil the contract we have with you, or to enter into a contract with you. We use this data to:
  • Give you the services we agreed to in line with our terms and conditions.
  • Send you messages about your account and other services you use if you get in touch, or we need to tell you about something.
  • Exercise our rights under the contracts we’ve entered into with you and resolve complaints and other issues.

Legal Obligation: It’s our legal duty to ensure that we are fully compliant with all applicable laws and regulations, including financial legislations such as: Anti-Money Laundering and Counter Terrorist Financing Laws. Further to our legal duty, we must collect and store certain personal information from you. Also, to protect against fraud we check your identity with your personal information.

Vital or Legitimate Interest: Processing may be done further to the legitimate interest of Alerzo, such as in safeguarding our assets, however, this will not be processed contrary to your rights and freedoms or further to the vital interest of a natural person. The following are examples of instances when we may process under vital or legitimate interests: an investigation of a breach of an agreement, contravention of laws, an emergency where the life, health or security of an individual is threatened, the collection of a debt or in compliance with the request of a law enforcement agency or a court order.
5. DISCLOSURE, PROCESSING AND RETENTION
5.1.
Alerzo will not disclose any of your personal information to anyone else, except:
5.1.1.
to its employees, independent contractors, subsidiaries, affiliates, consultants, business associates, service providers, suppliers and agents, acting on its behalf for any of the identified purposes;
5.1.2.
it has reason to believe that disclosure is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference (either intentionally or unintentionally) with our rights or property, other users of the Site, products or services, or anyone else that could be harmed by such activities;
5.1.3.
in the event of business transfers which may occur when we sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution or similar event, personal data may be part of the transferred assets; and
5.1.4.
to respond to judicial process and provide information to law enforcement agencies or in connection with an investigation on matters related to public safety, as permitted by law, or otherwise as required by law.
5.2.
We will only retain personal data on our servers for as long as is reasonably necessary, in so far as we are providing Services to you. If your account becomes inactive (that is, if you request to be removed from our database or close your account on the Site), we will keep your personal information in our archives for 5 (five) years before deletion or as otherwise required by relevant laws and regulations.

We also limit access to your personal data to only employees, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to similar data protection obligations and a duty of confidentiality.

We have put in place procedures to deal with suspected personal data breaches. We will also notify you and the relevant regulator of a breach, where we are required to do so

We maintain administrative, technical and physical controls designed to protect the personal data you provide, and we protect against loss or theft, as well as against any unauthorized access, risk of loss, disclosure, copying, misuse or modification.

Right to request that Alerzo delete your personal information. You have the right to ask us to delete your personal information. Please note that this is a limited right which applies where the data is no longer required, or the processing has no legal justification. The exceptions to this right is where the applicable law requires Alerzo to retain a historical archive or where we retain a core set of your personal data to ensure we do not inadvertently contact you in future where you object to your data being used for marketing purposes.

Right to correct or rectify any personal information that you provide which may be incorrect, out of date or inaccurate. You also have the right to ask us to complete information you think is incomplete.
v.
Right to object to the processing of your personal information. You also have a right to ask us not to contact you for marketing purposes by adjusting your notification preference on the settings page or by opting out via the unsubscribe link in marketing emails we send you. Please note that where you object to us processing your personal information, we might be unable to provide the our services to you.

In the event that a personal data breach has occurred impacting your Personal Data held with Alerzo that is likely to result in a high risk to your rights and freedoms, we shall immediately notify you of the breach in plain and clear language. We shall also notify the Data Protection Authority of such personal data breach within 72 (seventy-two) hours of becoming aware of the breach.
